A child pornography charge filed earlier this year against an Aberdeen man has been dismissed.


A child pornography charge filed earlier this year against an Aberdeen man has been dismissed.

Ryan T Kelly 28 had pleaded innocent to possession of child pornography. That's a high crime punishable by as much as 10 years in prison and a $10000 He had asked a jury trial.

Kimberly Dorsett, a delegate Brown County state's attorney, said there wasn't enough evidence to evidence beyond reasonable doubt that Kelly was the someone who downloaded the image. Another body could have used the computer or it have been the outcome of an unsolicited Internet advertisement called a pop-up ad.
